SEIU files complaint against Cacadia Liquor over use of replacement workers in B.C.

SEIU Local 2 has filed a legal complaint against Cascadia Liquor, alleging the company violated labour laws by employing replacement workers during an ongoing strike.

The complaint, submitted to the BC Labour Relations Board, claims that Cascadia Liquor used newly hired managers and head office employees to perform tasks typically carried out by striking workers.

The union’s complaint asserts that Cascadia Liquor, owned by the Truffles Group, directed non-union personnel to take over duties such as operating cash registers, assisting customers, and making deliveries — activities previously performed by unionized staff.

Cascadia Liquor workers from Quadra Village, Eagle Creek, and Colwood have been on strike since May 4, 2024. The union members, who joined SEIU Local 2 last year, have faced financial difficulties and inconsistent wage increases amidst rising living costs, the union said in a press release.

In response to these alleged actions, SEIU Local 2 has requested several remedies, including a declaration that Cascadia Liquor violated the Labour Relations Code, a cease and desist order, and damages for the purported conduct.

Section 68 of the BC Labour Relations Code specifically addresses the use of replacement workers during strikes, stating that employers must not use individuals hired or transferred after the commencement of collective bargaining to perform work normally done by striking employees.

SEIU Local 2 represents 20,000 workers across British Columbia, Ontario, Nova Scotia, New Brunswick, and Alberta.
