A Quebec-based manufacturing company, MTCA Inc., has been fined $70,000 after a serious workplace injury involving a forklift. The incident occurred at the company’s tote washing facility in Guelph, Ont.
On May 1, 2023, a malfunctioning dryer led to a three-hour shutdown, causing a trail of water to form along an aisle where workers were operating forklifts. The forklifts, not equipped with appropriate tires for wet conditions, became hazardous. A worker lost control of a forklift and collided with another worker, resulting in serious injuries.
In court, it was determined that MTCA Inc. failed to maintain a safe working environment as required by section 11(a) of Ontario Regulation 851/90, and section 25(1)(c) of the Occupational Health and Safety Act. This failure led to the conviction of MTCA Inc. on June 26, 2024.
Justice of the Peace Walter W. Rojek imposed the fine following a guilty plea. Additionally, a 25 per cent victim fine surcharge was applied, as mandated by the Provincial Offences Act. This surcharge contributes to a provincial fund assisting victims of crime.
