Delta Land fined $350,000 in Alberta after employee killed while working on excavator

A Red Deer, Alta., land development company has been fined $350,000 after pleading guilty to safety violations that led to a worker’s death at a resort construction site.

Delta Land pleaded guilty June 30 in Red Deer Court of Justice to one count under Alberta’s Occupational Health and Safety Code for allowing a worker to remain within range of moving parts on powered mobile equipment.

The charge relates to a fatal incident at the company’s Gull Lake resort development site on Nov. 8, 2022. A worker died after being caught between the boom and a grounded bucket while performing maintenance on an excavator.

The $350,000 fine includes a 20 per cent victim fine surcharge. The Crown withdrew six other charges as part of the plea agreement.

Both the company and Crown have 30 days to appeal the conviction or penalties.
